Among the earliest instances of a court's assuming authority to pronounce upon the constitutionality of an act of the legislature. By an Act of the Rhode Island Legislature of 1786, paper money issued by the State was made a legal tender. Weeden refused to receive this currency in payment of a debt. The Superior Court of the State summarily dismissed the case as not within the jurisdiction of the court. Though the record is imperfect, it is deemed virtually certain that the court pronounced the act of the legislature unconstitutional and void.
